Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you", "User"), and Integral Breath Academy LLC, a limited liability company formed in New Mexico, USA ("Company", "we", "us", or "our"), concerning your access to and use of the https://www.integralbreath.com website, as well as any other media form, media channel, online courses, digital products, consulting services, or breathwork sessions related, linked, or otherwise connected thereto (collectively, the "Services").

By accessing the Services, you agree that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the Services and you must discontinue use immediately.

We accept payments through secure third-party payment processors (including Stripe and major credit cards). You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. Prices are subject to change without notice. All payments shall be in U.S. Dollars (USD) unless otherwise explicitly stated. By providing a payment method, you represent and warrant that you are authorized to use the designated payment method and that you authorize us (or our third-party payment processor) to charge your payment method for the total amount of your purchase.

Due to the digital nature of our Services (including instant access to digital audio content, online courses, and digital downloads), all sales are final. Once a digital product has been purchased and accessed or downloaded, we do not offer refunds, exchanges, or cancellations.

For services that involve live scheduling, such as one-on-one sessions and group online events, the following cancellation policies apply:

1:1 Sessions: We require a minimum of 48 hours’ notice to cancel or reschedule a one-on-one session. If you cancel or request to reschedule at least 48 hours before your scheduled appointment, you will receive a full refund or the option to reschedule. Cancellations made less than 48 hours in advance, as well as no-shows, are strictly non-refundable and the full fee for the session will be forfeited.

Online Group Events: If you need to cancel your participation in a live online group session, workshop, or event, you must notify us at least 5 days prior to the scheduled start date to receive a full refund. Cancellations made less than 5 days before the event are strictly non-refundable.

The breathwork and yoga nidra sessions and digital audio content are for self-experience and prevention. They are not medical or psychotherapeutic treatment and do not replace examination or therapy by a physician. Participation is at your own responsibility; with pre-existing conditions (especially cardiovascular, epilepsy, pregnancy) seek medical advice beforehand.

Unless otherwise indicated, the Services and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein are owned or controlled by us and are protected by copyright and trademark laws. You are granted a limited license to access and use the Services and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use.

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, MENTORS, FACILITATORS, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

These Terms and your use of the Services are governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law principles. Any legal action or proceeding related to your access to or use of the Services shall be instituted in a state or federal court in New Mexico, and you agree to submit to the jurisdiction of, and agree that venue is proper in, these courts.
